1. Introduction

These Reflecta European Terms of Use (the “European Terms”) apply to you if you are ordinarily resident in the European Economic Area, Switzerland or the United Kingdom when you create an Account, first access the Services or purchase Paid Services.

These European Terms supplement the Reflecta Terms of Use and apply in addition to them. Where these European Terms conflict with the Reflecta Terms of Use, these European Terms prevail for users within their scope, but only to the extent of the inconsistency.

These European Terms are intended to preserve rights that you may have under mandatory consumer protection, digital content, digital services, data protection, platform, contract and other applicable laws in the European Economic Area, Switzerland or the United Kingdom.

2. Contracting Entity

Reflecta may update the contracting entity identified in these European Terms where reasonably necessary following a merger, acquisition, internal reorganisation, transfer of business, restructuring or similar corporate event, provided that such update does not reduce your mandatory rights under applicable law.

3. Relationship with Other Reflecta Documents

These European Terms should be read together with the following documents:

In the event of inconsistency between these documents, the following order applies, unless a specific document expressly provides otherwise for a particular Service, feature or transaction:

  • mandatory applicable law;
  • these European Terms, for users within their scope;
  • feature-specific notices, purchase screens or supplemental terms applicable to the specific feature or purchase;
  • the Reflecta Terms of Use;
  • the Reflecta Acceptable Use, Content Safety and Notice-and-Takedown Policy;
  • other policies incorporated by reference.

The Reflecta Privacy Notice governs the processing of Personal Data. The Reflecta Cookie and Similar Technologies Notice governs the use of cookies, local storage and similar technologies. Nothing in these European Terms limits your rights under applicable data protection law.

4. Definitions

Capitalised terms used but not defined in these European Terms have the meanings given to them in the Reflecta Terms of Use.

For the purposes of these European Terms:

Consumer
means a natural person acting for purposes that are outside that person’s trade, business, craft or profession.
European User
means a user who is ordinarily resident in the European Economic Area, Switzerland or the United Kingdom.
Paid Services
means subscriptions, Credits, premium features, paid digital functionality, credit packs, enhanced Outputs, high-resolution exports, business plans or other paid offerings made available through the Services.
Services
has the meaning given in the Reflecta Terms of Use and includes the Reflecta website, iOS mobile application, software, AI Features, account workspaces, content libraries, billing features, support channels and related services.

5. Scope of these European Terms

These European Terms apply where you are a European User.

If you use the Services on behalf of an organization, business or professional client, these European Terms apply only to the extent that mandatory law grants the relevant rights or protections to you or that organization.

Certain protections in these European Terms apply only to Consumers. Where a clause is stated to apply to Consumers, it does not apply to business users unless mandatory law requires otherwise.

6. European Consumer Rights

If you are a Consumer, you benefit from mandatory rights under the consumer protection and digital content laws applicable in your country of habitual residence.

Nothing in the Reflecta Terms of Use, these European Terms or any incorporated policy excludes, restricts or limits any statutory right, remedy or guarantee that cannot lawfully be excluded, restricted or limited.

Where the Reflecta Terms of Use, these European Terms or any incorporated policy conflict with mandatory consumer protection law, the applicable mandatory law prevails to the extent of the inconsistency.

7. Digital Content and Digital Services

The Services may include digital content and digital services supplied electronically, including AI-powered generation tools, image editing tools, generated Outputs, subscriptions, Credits, high-resolution exports, account workspace features and related online functionality.

Where required by applicable law, Reflecta will provide digital content and digital services in conformity with these European Terms, the Reflecta Terms of Use, information presented at the point of purchase, and applicable law.

If Paid Services do not conform to applicable contractual or statutory requirements, you may be entitled to remedies available under applicable law, which may include bringing the digital content or digital service into conformity, a proportionate price reduction, termination, refund or other statutory remedy.

Nothing in these European Terms limits those statutory remedies.

8. About the Services

Reflecta is an AI-powered creative generation platform with private user workspaces. The Services allow users to upload or select visual assets, create and manage workspaces, use platform-provided materials, and generate visual Outputs using AI-powered tools.

Reflecta does not operate a public social network, public feed or public in-app user-to-user content platform.

The Services evolve over time. Reflecta may introduce new functionality, improve existing features, replace underlying technologies, change AI Infrastructure Providers, adjust safety controls, modify pricing or discontinue features where reasonably necessary, subject to applicable law and any specific commitments made to you.

9. Eligibility and Accounts

The Reflecta Terms of Use govern Account creation, Account security, eligibility, Workspace use and business use.

The Services are intended only for users who are at least 18 years old and have reached the age of majority in their jurisdiction of residence.

You must not create an Account, upload Assets, generate Outputs, purchase Paid Services or otherwise use the Services if you are under 18, have not reached the age of majority in your jurisdiction, or are not legally permitted to use the Services.

10. Artificial Intelligence Services

10.1 AI-Generated Outputs

Outputs are generated through machine-learning systems that operate probabilistically rather than deterministically. As a result, Outputs may:

  • differ from your instructions or reference materials;
  • vary between identical generation requests;
  • contain inaccuracies or inconsistencies;
  • omit or introduce visual elements;
  • resemble Outputs generated for other users;
  • contain artefacts, distortions or unexpected features;
  • require human review before publication or commercial use.

The existence of similar Outputs does not, by itself, indicate that Reflecta has disclosed your User Assets, breached your Account or Workspace security, or violated these European Terms.

10.2 User Review

You are responsible for reviewing Outputs before using, publishing, distributing or commercially exploiting them.

Depending on your intended use, you may need to verify:

  • factual accuracy;
  • legal compliance;
  • technical accuracy;
  • commercial suitability;
  • branding consistency;
  • third-party rights;
  • compliance with advertising, consumer protection, product, intellectual property, data protection and other applicable regulatory requirements.

Reflecta recommends that Outputs intended for professional, commercial, public or regulated use be reviewed by an appropriately qualified person before publication or deployment.

Outputs generated by artificial intelligence should not be interpreted as statements of fact, official product images, professional advice, authentic endorsements, verified factual depictions or human-only creations unless they have been appropriately verified and are not misleading in context.

10.3 Similarity and Non-Uniqueness

AI systems may generate Outputs that are identical or similar to Outputs generated for other users.

Reflecta does not guarantee that Outputs will be unique, exclusive, protectable by copyright or free from third-party rights.

Similarity between Outputs does not, by itself, mean that Reflecta has disclosed your User Content or granted another user access to your Account or Workspace.

11. High-Risk Uses

Unless Reflecta expressly states otherwise, the Services are not designed or intended for uses where applicable law requires human oversight or where inaccurate Outputs may create significant legal or similarly significant effects on individuals.

You must not use the Services or Outputs as the sole basis for legal, financial, medical, employment, housing, insurance, immigration, law-enforcement, biometric-identification or similarly significant decisions about a person.

Reflecta does not monitor or determine whether your intended use constitutes a high-risk use under applicable law. You remain responsible for determining whether the Services are appropriate and lawful for your intended use.

12. AI Transparency

Where applicable law, platform rules or industry standards require disclosure that content has been generated or materially modified using artificial intelligence, you are responsible for ensuring that any required disclosure is made.

You must not use Outputs to mislead others about authenticity, provenance, endorsement, affiliation, authorship, certification, sponsorship or whether content was created or materially modified using AI.

13. Privacy and Data Protection

Reflecta processes Personal Data in accordance with the Reflecta Privacy Notice.

Nothing in these European Terms limits any rights available to you under GDPR, UK GDPR, Swiss data protection law or other applicable data protection law.

Depending on applicable law, you may have rights to access, correct, delete, restrict, object to processing, port your data, withdraw consent and lodge complaints with supervisory authorities.

Where Reflecta relies on consent for a processing activity, withdrawal of consent does not affect processing carried out before withdrawal. If you withdraw consent necessary to provide an image-processing or AI-generation feature, that feature may no longer be available.

14. AI Training

Reflecta recognises that transparency regarding the use of user data is fundamental to user trust.

Unless Reflecta clearly informs you otherwise and obtains any consent required by applicable law, Reflecta does not use your uploaded User Assets, prompts, generated Outputs or Personal Data to train Reflecta’s general AI models or create separate AI products made available to other users.

Nothing in this Section prevents Reflecta from processing User Content where reasonably necessary to:

  • provide the Services;
  • generate Outputs requested by you;
  • maintain and secure the Services;
  • apply safety controls;
  • detect or prevent misuse;
  • investigate technical issues;
  • debug and maintain service reliability;
  • comply with applicable legal obligations;
  • respond to rights complaints, abuse reports or legal requests.

Third-party AI Infrastructure Providers may process inputs, prompts, User Assets, Outputs and related technical data in accordance with their own terms, privacy policies, data processing commitments and technical safeguards, as further described in the Privacy Notice.

15. Biometric Processing and Image Use

Reflecta is a creative generation platform and is not intended to function as a biometric identification, facial recognition, face-matching, person-search, liveness-detection or identity verification service.

Unless expressly stated for a specific feature, Reflecta does not use uploaded images to identify natural persons, authenticate identities, verify identities, compare users, search for individuals, create face IDs, create biometric templates, create liveness profiles or build facial recognition databases.

Images submitted through the Services are processed as visual assets and reference inputs for the purposes described in the Reflecta Terms of Use and the Privacy Notice, including creative generation, asset management, output delivery, safety controls, service operation, support, security and legal compliance.

Images may reveal sensitive information. You should not upload images containing sensitive information if you do not want that information processed for the purposes described in the Privacy Notice.

16. Respect for Third-Party Rights

You remain responsible for ensuring that your use of the Services, User Assets, prompts and Outputs respects the rights of others.

The availability of AI Features does not authorise the use of third-party content or remove the need to obtain any permissions required for your intended use.

16.1 Images Depicting Individuals

Where User Assets depict one or more identifiable individuals, you are responsible for ensuring that your use of those images complies with applicable law.

Depending on the circumstances, this may include obtaining consent, model releases, employee consents, influencer consents, customer consents or other permissions, or relying on another lawful basis recognised under applicable law.

Reflecta does not independently verify whether you possess the necessary permissions to upload or process images depicting identifiable individuals.

You must not upload images of minors.

16.2 Brands and Commercial Identifiers

Outputs may include elements associated with brands, products, trade dress or other commercial identifiers.

You remain responsible for ensuring that your use of such Outputs complies with applicable intellectual property, advertising, consumer protection and unfair competition laws.

The generation of an Output incorporating third-party intellectual property does not, by itself, grant permission to use that Output in a manner that would otherwise infringe applicable law.

17. Content Safety and Reports

To maintain a safe and lawful service, Reflecta expects all users to use the Services responsibly and in accordance with:

  • these European Terms;
  • the Reflecta Terms of Use;
  • the Reflecta Acceptable Use, Content Safety and Notice-and-Takedown Policy;
  • the Reflecta Privacy Notice;
  • applicable law.

Reflecta may use automated systems, AI provider safety controls, human review, user reporting channels and other reasonable technical and organisational measures to maintain the security and integrity of the Services and enforce its contractual framework.

Reflecta does not guarantee that all unlawful, infringing, unsafe or policy-violating content will be detected or blocked.

18. Reports of Illegal, Infringing or Harmful Content

Any person may notify Reflecta of content that they reasonably believe:

  • infringes intellectual property rights;
  • violates privacy, publicity, image or personality rights;
  • is unlawful under applicable law;
  • involves minors or child safety concerns;
  • involves non-consensual image use;
  • involves harmful impersonation or misleading synthetic media;
  • materially breaches the contractual rules governing the Services.

Reports should contain sufficient information to enable Reflecta to identify the relevant content and understand the basis of the report.

Reflecta may request additional information where reasonably necessary before determining whether any action is appropriate.

The detailed reporting, notice-and-action, takedown, appeal, counter-notice and repeat misuse procedures are set out in the Reflecta Acceptable Use, Content Safety and Notice-and-Takedown Policy.

19. Assessment of Reports

Reflecta reviews reports diligently, objectively and in good faith.

When assessing a report, Reflecta may consider:

  • the information submitted by the reporting party;
  • information available to Reflecta;
  • applicable law;
  • the rights and legitimate interests of affected persons;
  • the seriousness of the alleged conduct;
  • whether urgent safety or legal risk is involved;
  • whether the report appears abusive, incomplete, false or repetitive;
  • any other circumstances reasonably relevant to the assessment.

Reflecta may determine that no further action is necessary where it concludes that the reported content or conduct does not violate applicable law or the contractual framework governing the Services.

20. Enforcement Measures

Where Reflecta reasonably concludes that content or conduct violates the Reflecta Terms of Use, these European Terms, the Reflecta Acceptable Use, Content Safety and Notice-and-Takedown Policy or applicable law, Reflecta may take proportionate measures to protect the Services and affected persons.

Such measures may include:

  • requesting additional information;
  • restricting access to particular content;
  • removing or disabling content;
  • limiting access to specific features;
  • issuing warnings;
  • temporarily suspending an Account;
  • permanently terminating an Account;
  • restricting a Workspace;
  • preserving evidence;
  • taking any other reasonable measure necessary to prevent continued misuse.

Reflecta will seek to ensure that enforcement measures are proportionate, taking into account the nature, seriousness and frequency of the relevant conduct.

Where required by applicable law, Reflecta will provide affected users with appropriate information regarding significant enforcement decisions.

21. Review of Enforcement Decisions

Where Reflecta takes significant enforcement action affecting an Account or User Content, the affected user may request that Reflecta review the relevant decision in accordance with the procedures described in the Reflecta Acceptable Use, Content Safety and Notice-and-Takedown Policy.

Reflecta will review such requests within a reasonable period and communicate the outcome to the user where appropriate.

Nothing in this Section limits any statutory rights, remedies or complaint rights available under applicable law.

22. Consumer Complaints

Consumers may contact Reflecta using the contact details provided in these European Terms or the Reflecta Terms of Use regarding complaints relating to the Services.

Reflecta will consider consumer complaints in accordance with applicable law and its internal procedures.

Nothing in this Section limits your right to submit complaints to competent supervisory, consumer protection, platform, data protection or other authorities where provided by applicable law.

23. Paid Services

Paid Services remain governed by the Reflecta Terms of Use, purchase screens, subscription disclosures and any applicable supplemental terms. This Section applies only to the extent required by applicable European consumer protection law.

Before concluding a contract for Paid Services, Reflecta will provide the information required by applicable law, which may include:

  • the main characteristics of the Paid Service;
  • the price, taxes and payment terms;
  • the subscription period, if applicable;
  • renewal and cancellation terms;
  • any trial or promotional terms;
  • whether digital content or digital services are supplied immediately;
  • any applicable withdrawal-right information;
  • any relevant technical restrictions;
  • the identity and contact details of the contracting entity.

24. Digital Services and Withdrawal Rights

Where Paid Services consist of digital content or digital services supplied electronically, Reflecta may begin providing the relevant Service immediately after your purchase.

Where applicable law grants Consumers a statutory withdrawal period, Reflecta may request your express consent to commence performance before the expiry of that period.

Where required by law, Reflecta may also request your acknowledgement that commencement of the Service may affect your statutory withdrawal rights.

Nothing in these European Terms excludes or limits any withdrawal rights that cannot lawfully be excluded or limited.

25. Subscriptions

Subscription terms, including renewal, billing, cancellation arrangements, trial terms and price information, will be disclosed before purchase as required by applicable law.

Unless otherwise stated, Subscriptions renew automatically until cancelled.

You may cancel a recurring Subscription at any time before the next renewal date using the subscription management tools made available by Reflecta, Apple, Stripe or the relevant payment provider.

Cancellation takes effect at the end of the current billing period unless applicable law, the relevant App Marketplace rules, the purchase terms or payment-provider rules provide otherwise.

Deleting the application from your device does not cancel your Subscription. Deleting your Account may not cancel a Subscription processed by Apple, Stripe or another payment provider unless the relevant purchase channel confirms cancellation or applicable law requires otherwise.

26. Credits and Virtual Items

Reflecta may offer Credits, tokens, packs or similar digital items that can be redeemed within the Services for eligible features.

Credits and virtual items have no monetary value outside the Services, are not legal tender, are not transferable except as expressly permitted by Reflecta, and may be used only within the Services.

Credits included as Subscription benefits may be available only during the applicable Subscription period unless expressly stated otherwise.

Credits purchased separately through Apple IAP will not expire where Apple rules prohibit expiry. Other Credits, including promotional, bonus, manually issued, web-purchased or Subscription-included Credits, may be subject to the expiry or usage terms disclosed at the point of purchase, subject to applicable law.

Nothing in this Section limits any consumer rights that cannot lawfully be excluded or limited.

27. Changes to Prices

Reflecta may revise the prices applicable to Paid Services from time to time.

Where required by applicable law, Reflecta will notify you of price changes in advance and you may cancel the relevant Paid Service before the revised price becomes effective.

If you do not cancel before the new price becomes effective, your continued use of the relevant Paid Service may be treated as acceptance of the new price, subject to applicable law and App Marketplace rules.

28. Payment Providers and App Marketplaces

Payments may be processed by independent third-party payment providers or App Marketplaces.

Purchases made through Apple IAP are subject to Apple’s billing, payment, cancellation and refund procedures.

Purchases made through the Reflecta website may be processed by Stripe or another payment processor and may be subject to that provider’s terms and policies.

Reflecta is not responsible for independent acts or omissions of payment providers or App Marketplaces outside Reflecta’s reasonable control.

Nothing in this Section limits rights you may have against Reflecta under mandatory law.

29. Refunds and Remedies

Refunds are governed by the Reflecta Terms of Use, purchase disclosures, applicable App Marketplace rules, payment-provider procedures and applicable law.

For Apple IAP purchases, refund requests must be submitted through Apple’s refund process. Reflecta cannot process Apple refunds directly.

For website purchases, refund requests may be submitted to support@tryreflecta.app or through the applicable billing portal where available.

If you are a Consumer, mandatory consumer rights may entitle you to remedies where Paid Services do not conform to applicable requirements. Such remedies may include repair, replacement, bringing the service into conformity, proportionate price reduction, cancellation, refund or other remedies available under applicable law.

Nothing in these European Terms limits any statutory remedy that cannot lawfully be limited.

30. Suspension and Termination

The Reflecta Terms of Use govern suspension and termination of Accounts, Workspaces, Paid Services, Credits and access to the Services.

Where you are a Consumer and mandatory law requires notice, reasons, review options or other procedural protections before or after suspension or termination, Reflecta will provide those protections to the extent required by applicable law.

Nothing in these European Terms limits Reflecta’s ability to take urgent action where reasonably necessary to address illegal content, child safety, serious harm, fraud, abuse, sanctions risk, security incidents, payment fraud, legal obligations or app marketplace requirements.

31. Liability

Liability is governed by the Reflecta Terms of Use, except as modified by this Section and mandatory applicable law.

Nothing in the Reflecta Terms of Use or these European Terms excludes or limits liability where such exclusion or limitation is prohibited under applicable law.

Nothing in the Reflecta Terms of Use or these European Terms excludes or limits liability for:

  • death or personal injury caused by negligence, where applicable law prohibits exclusion or limitation;
  • fraud or fraudulent misrepresentation;
  • wilful misconduct where liability cannot be excluded;
  • failure to provide mandatory consumer remedies;
  • breach of mandatory digital content or digital service conformity obligations;
  • any other liability that cannot lawfully be excluded or limited.

Where you are a Consumer, any limitation of liability applies only to the extent permitted by the law of your country of habitual residence.

32. Governing Law and Jurisdiction

The Reflecta Terms of Use are governed by the law specified in those Terms, except where mandatory law requires otherwise.

Nothing in these European Terms or the Reflecta Terms of Use deprives Consumers of the protection afforded by mandatory provisions of the law applicable in their country of habitual residence.

Where mandatory law grants Consumers the right to bring proceedings before the courts of their country of habitual residence, nothing in these European Terms or the Reflecta Terms of Use limits that right.

Nothing prevents either party from seeking interim or protective measures before any competent court where such relief is available under applicable law.

33. Arbitration and Consumer Rights

If you are a Consumer, nothing in these European Terms or the Reflecta Terms of Use requires you to resolve disputes exclusively through arbitration or prevents you from bringing proceedings before the courts or competent authorities of your country of habitual residence where such right is provided by applicable law.

Any arbitration, class action waiver, jury trial waiver or exclusive forum provision in the Reflecta Terms of Use applies only to the extent permitted by mandatory law.

If such a provision is not enforceable against you as a Consumer under applicable law, it will not apply to you, but the remaining provisions will continue to apply to the fullest extent permitted by law.

34. Changes to these European Terms

Reflecta may update these European Terms from time to time to reflect changes in the Services, technology, law, provider requirements, payment rules, App Marketplace rules, safety practices or business operations.

Where required by applicable law, Reflecta will provide notice of material changes or request acceptance.

If you do not agree to updated European Terms, you must stop using the Services, close your Account and cancel any active Subscription. Continued use of the Services after updated European Terms become effective constitutes acceptance to the extent permitted by applicable law.
